Projects: Expert Advisory Group

About

The Expert Advisory Group project was established in 2001 to:

  • Identify priority legal and regulatory issues affecting VET learning online,
  • Prepare responses and/or articulate key implementation issues,
  • Advise key Framework stakeholders, the Australian National Training Authority (ANTA) CEOs, through the Flexible Learning Advisory Group (FLAG), of the implications of the evolving legal and regulatory framework, having regard to the activities and priorities of other education and training sectors.

The aim of the project was to assist the Flexible Learning Advisory Group to advocate that the legal and regulatory framework in Australia:

  • Provides adequate protection for learners,
  • Removes legal and regulatory barriers to the effective use of information technology in VET, and
  • Fosters open trade in Australian VET products and services.

Five sub-projects were conducted in 2002:

  • Electronic Authentication for Flexible Learning,
  • Maximising Collaboration in the Use of Intellectual Property,
  • Good Practices in the Use of Intellectual Property for Flexible Learning,
  • Copyright in a Flexible Learning Environment,
  • Register of Legal and Regulatory Expert Database.

This project has leveraged the outcomes of the Strategy 2001 Legal and Regulatory Framework project. It directly references the outcomes of this project and works in close collaboration with the 2002 Legal Issues for Flexible Learning project.

Legal Issues in Electronic Authentication for Flexible Learning (1.83 mb)
This research and advisory paper examines existing legal and regulatory framework in three categories:

  • Legislation;
  • Guidelines and codes; and
  • Common law.

The paper outlines the current legal and regulatory framework for electronic authentication in Australia. It also covers general and specific legal and regulatory issues relevant to educational providers and outlines suggested models for electronic authentication in VET. The paper concludes with findings and recommendations for the way forward.
